Section 12-501 - Definitions.

§ 12-501. Definitions.
 

(a)  In general.- In this subtitle the following words have the meanings indicated.

(b)  Building.- "Building" has the meaning stated in the International Building Code.

The former reference to the "interpretation set forth" in the International Building Code is deleted as unnecessary because the International Building Code does not include interpretive guidance.

"International Building Code"                                       § 12-501

(c)  Department.- "Department" means the Department of Housing and Community Development.

This subsection is new language added to avoid repetition of the full title "Department of Housing and Community Development". 

(d)  International Building Code.-  

(1) "International Building Code" means the first printing of the most recent edition of the International Building Code issued by the International Code Council. 

(2) "International Building Code" does not include interim amendments or subsequent printings of the most recent edition of the International Building Code.

In paragraph (1) of this subsection, the former word "periodically", which modified "issued", is deleted as surplusage. 
 

Also in paragraph (1) of this subsection, the former reference to "the organization known as" the International Code Council is deleted as surplusage. 

(e)  International Energy Conservation Code.-  

(1) "International Energy Conservation Code" means the first printing of the most recent edition of the International Energy Conservation Code issued by the International Code Council. 

(2) "International Energy Conservation Code" does not include interim amendments or subsequent printings of the most recent edition of the International Energy Conservation Code. 

(f)  Local jurisdiction.- "Local jurisdiction" means the county or municipal corporation that is responsible for implementation and enforcement of the Standards under this subtitle.

The reference to a "municipal corporation" is substituted for the former reference to a "municipality" to conform to Md. Constitution, Art. XI-E. 
 

The general reference to implementation and enforcement of the Standards "under this subtitle" is substituted for the former specific reference to implementation and enforcement "as more specifically provided in § 6-402(f) of this subtitle" because a specific cross-reference to a provision is generally not necessary in a definition.

(g)  Standards.- "Standards" means the Maryland Building Performance Standards.

The defined term "Standards" is intended to be used as a shorthand reference to the "Maryland Building Performance Standards". 
 

The former reference to the Maryland Building Performance Standards being "the International Building Code adopted by the Department under § 6-402 of this subtitle" is deleted as unnecessary in the definition because the substantive provision that requires the Department to adopt the International Building Code is stated in § 12-503(a) of this subtitle. 

(h)  Structure.- "Structure" has the meaning stated in the International Building Code.
