Article - State Government

§ 9-1211.

      (a)      There is a State Prosecutor Selection and Disabilities Commission.

      (b)      The Commission consists of the Attorney General, ex officio, but with power to vote, and six individuals appointed by the Governor as follows:

            (1)      two individuals, only one of whom shall be a lawyer, shall be selected from among two or more nominees who are not members of the General Assembly or full-time State employees whose names are submitted by the President of the Senate;

            (2)      two individuals, only one of whom shall be a lawyer, shall be selected from among two or more nominees who are not members of the General Assembly or full-time State employees whose names are submitted by the Speaker of the House of Delegates;

            (3)      one individual who is a lawyer admitted to practice law in the State shall be selected from among one or more nominees submitted by the Board of Governors of the Maryland State Bar Association, Incorporated; and

            (4)      one individual, who is an incumbent State's Attorney at the time of appointment and throughout the term as a member of the Commission, shall be selected from among one or more nominees submitted by the governing board of the Maryland State's Attorneys Association, Incorporated, or its successor.

      (c)      (1)      The Governor shall appoint the members of the Commission from among the nominees submitted as prescribed in this section.

            (2)      The Governor may reject the nominee or any of the nominees for cause only.

            (3)      If the Governor rejects a nominee, the Governor shall request the appropriate nominating authority to submit another nominee or nominees as necessary.

      (d)      (1)      The term of a member is 4 years.

            (2)      A member serves until a successor is appointed and qualifies.

            (3)      Of the initial appointees, two shall have initial terms of 4 years, two shall have initial terms of 3 years, and two shall have initial terms of 2 years.

            (4)      Members are eligible for reappointment.

      (e)      The Governor shall designate one of the Commission members as chairman for the time period as the Governor determines.

      (f)      Any vacancy occurring on the Commission shall be filled by the Governor in the same manner as provided for appointments to the Commission.

      (g)      A member of the Commission may not receive compensation but shall be reimbursed for reasonable expenses incurred in the performance of the member's duties, as provided in the State budget.
