Article - Health Occupations

§ 15-313.

      (a)      (1)      Except as otherwise provided under § 10-226 of the State Government Article, before the Board takes any action to deny a certificate or to reject or modify a delegation agreement, the Board shall give the applicant or certificate holder the opportunity for a hearing before the Board.

            (2)      The Board shall give notice and hold the hearing under Title 10, Subtitle 2 of the State Government Article.

            (3)      The Board may administer oaths in connection with any proceeding under this section.

            (4)      At least 14 days before the hearing, the hearing notice shall be sent to the last known address of the applicant or certificate holder.

      (b)      Any applicant aggrieved under this subtitle by a final decision of the Board denying a certificate or denying or modifying a delegation agreement may:

            (1)      Appeal that decision to the Board of Review; and

            (2)      Then take any further appeal allowed under Title 10, Subtitle 2 of the State Government Article.
