Maryland Health - General Section 24-401

      (a)      In this subtitle the following words have the meanings indicated.

      (b)      "Bedding" means any quilted pad, mattress pad, hammock pad, mattress, comforter, quilt, sleeping bag, box spring, studio couch, sofa bed, convertible sofa, pillow, or cushion that:

            (1)      Is stuffed or filled wholly or partly with concealed material; and

            (2)      Can be used by an individual for sleeping or reclining.

      (c)      "Disinfect" means to rid bedding, bedding component parts, or filling material of:

            (1)      Live microorganisms that may cause disease; and

            (2)      Live bugs and pests.

      (d)      "Disinfector" means a person who disinfects bedding, bedding component parts, or filling material.

      (e)      "Filling material" means any material that is used or intended to be used as filling in bedding or upholstered furniture.

      (f)      "Importer" means a retailer who imports bedding, upholstered furniture, or filling material that is manufactured in a foreign country.

      (g)      "License" means, except as otherwise provided in this subtitle, a license issued by the Department under this subtitle to engage in business as a disinfector, importer, manufacturer, renovator, supply dealer, or wholesaler.

      (h)      "Make" means to alter, finish, or prepare bedding, upholstered furniture, or filling material for sale, regardless of whether the bedding, upholstered furniture, or filling material is composed of new or secondhand material.

      (i)      "Manufacturer" means a person who, using either new or secondhand material:

            (1)      Makes wholly or partly bedding or upholstered furniture; or

            (2)      Applies the upholstery or covering on any structural unit of bedding or upholstered furniture.

      (j)      (1)      "New" means not used previously for any purpose.

            (2)      For purposes of this definition, a manufacturing process is not a previous use.

      (k)      "Renovate" means to repair, re-cover, or renew bedding or upholstered furniture.

      (l)      "Renovator" means a person who renovates bedding or upholstered furniture.

      (m)      "Secondhand" means not new.

      (n)      (1)      "Sell" means to dispose of in any commercial manner.

            (2)      "Sell" includes:

                  (i)      To possess with intent to sell; or

                  (ii)      To offer, display, or advertise for sale.

      (o)      "Supply dealer" means a person who makes or sells at wholesale any filling material.

      (p)      (1)      "Upholstered furniture" means any furniture that is stuffed or filled with filling material.

            (2)      "Upholstered furniture" does not include bedding.

      (q)      (1)      "Wholesaler" means a person who sells any bedding or upholstered furniture to another person for resale.

            (2)      "Wholesaler" does not include an affiliate or subsidiary corporation of a manufacturer that is the exclusive sales outlet of the manufacturer.
