Article - Maryland-National Capital Park and Planning Commission

§ 8-111.1.

      (a)      (1)      Any person aggrieved by the decision of the board of zoning appeals of Prince George's County and a party to the proceeding before it may appeal to the circuit court for the county which shall have power to affirm the decision of the board, or if the decision is not in accordance with law, to modify or reverse the decision, with or without remanding the case for rehearing as justice may require.

            (2)      Any party to the proceeding in the circuit court aggrieved by the decision of the court may appeal from the decision to the Court of Special Appeals.

      (b)      (1)      The board of zoning appeals of Prince George's County shall take any action necessary to enforce any final decision of the board.

            (2)      Any request or application for a stay from a final decision of the board of zoning appeals of Prince George's County shall be filed in the circuit court of the county.

            (3)      Unless modified or reversed by the circuit court for the county, a decision of the board of zoning appeals in Prince George's County concerning any nonconforming occupancy or use is binding on the parties and continues in force and effect.
