Article - Public Defender

§ 14.

      The provisions of this article shall not apply to any county where the county commissioners, or the county executive and county council, prior to September 1, 1971, shall determine to and in fact shall implement or maintain at the county's expense a separate or different system for providing counsel to indigent accused persons. Any county which determines to implement a separate or different system may subsequently rescind such determination and be included under the provisions of this article upon notification to the Public Defender by the county government, provided, however, that the provisions of this article shall not become effective in a county rescinding its determination until such date as the Public Defender determines that it is feasible to provide the county with services pursuant to this article.
