Article - County Commissioners

§ 200.

      (a)      The public watershed association shall by virtue of this subtitle have the power and authority to acquire and possess such rights-of-way, easements and other property rights necessary for the construction and maintenance of the works of improvement for watershed protection, flood prevention, recreation, soil conservation, drainage, and/or the conservation, development, storage, utilization and disposal of water for all beneficial purposes.

      (b)      Every public watershed association in this State shall submit to the clerk of the circuit court in the appropriate county a suitable book, to be known as the "easement record", which contains all of the easements for maintenance or rights-of-way, according to the original design specifications or for not less than 20 feet, that the association has on any land in the county. The association shall bear the responsibility to keep the "easement record" up to date and current. The clerk of each court shall make this "easement record" available for inspection by the public.
