§5807. Cost of removing architectural barriers

Notwithstanding the maximum tuition rate established under sections 5805 and 5806, public and private schools may adjust their tuition rate for the express purpose of complying with the requirements of the United States Vocational Rehabilitation Act of 1973, Section 504, Public Law 93-112. 1. Prior approval of the commissioner. Projects, costs to bring the facilities into compliance and the method and time period of financing must receive prior approval of the commissioner.

2. Calculation of adjustment. The cost adjustment for each student shall be calculated by dividing:

A. The lesser of the actual compliance costs or debt retirement payments of the year immediately prior to the year for which the tuition charge is computed by; and [1981, c. 693, §§ 5, 8 (NEW).]

B. The average number of students attending the school on October 1st and April 1st of the same year. [1981, c. 693, §§ 5, 8 (NEW).]

3. Sunset provisions. The provisions of this subsection shall apply to minor capital projects which have received departmental approval before June 30, 1982.
