§160.11. Public purpose and tangible benefit

The department, by implementing the provisions of this Subpart, establishing an account, and contracting with an insurer or managed care plan to provide health care services and treatments to a participant or other eligible individual, shall be presumed to be engaged in a cooperative endeavor as provided by Article VII, Section 14(C) of the Constitution of Louisiana. The department shall be further presumed by the establishment of an account and the execution of such an insurance or managed care plan contract to have done so for the purpose of obtaining a tangible benefit and for a public purpose, and such a voucher, account, or a health insurance or managed care plan contract shall not be presumed to be a donation in contravention of Article VII, Section 14(A) of the Constitution of Louisiana.
