§2113. Transportation Mobility Fund; applications for funding; project eligibility; limitations; ranking and prioritizing project applications

A.(1) All projects competing for funding from the Transportation Mobility Fund shall comply with the provisions of R.S. 48:2114. To qualify for funding from the Transportation Mobility Fund a project shall be either a mega project from Priority list A through D of the Department of Transportation and Development's Statewide Transportation Plan or identified as a mega project by the board of the Louisiana Transportation Authority, hereinafter referred to as the "board", and recommended by such board to be included as a mega project in an update of the department's Statewide Transportation Plan. Applications for funding of projects shall be submitted to the board no later than March first of each year.

(2) The Department of Transportation and Development may submit applications for other mega projects which are not on the Statewide Transportation Plan for funding from the Transportation Mobility Fund if such projects meet criteria established by the Louisiana Transportation Authority.

(3) A mega project constructed by the Louisiana Transportation Authority before the establishment or funding of the Transportation Mobility Fund which project is funded in whole or in part by tolls may have such preexisting tolls considered in applying for Transportation Mobility Fund funds for subsequent phases of construction of the mega project.

B. The board shall promulgate rules and regulations in accordance with the Administrative Procedure Act as are necessary to implement the provisions of this Chapter, including but not limited to rules and regulations for the submission of applications and establishment of factors and criteria for the development of a system and procedure for prioritizing and ranking project funding applications. All rules and regulations promulgated by the board shall be subject to oversight by the House and Senate Committees on Transportation, Highways and Public Works.

C. No later than May first of each year, the board shall meet in order to discuss applications for funding from the Transportation Mobility Fund. The board shall have one hundred twenty days to make final determinations regarding funding ranks for projects. The board shall submit a report of its final determinations to the House and Senate Transportation, Highways and Public Works committees each year and, upon a written request, shall make such list available to the public.
