CHAPTER 31. LOUISIANA IMMERSIVE TECHNOLOGIES ENTERPRISE

§2101. Louisiana Immersive Technologies Enterprise Commission; creation; membership

A. The Louisiana Immersive Technologies Enterprise was established with the approval and cooperation of the Louisiana Department of Economic Development, the Lafayette Economic Development Authority, and the University of Louisiana at Lafayette.

B. The Louisiana Immersive Technologies Enterprise serves the state by furthering education in immersive technologies, engaging in collaborative research involving immersive technologies, and by furthering the economic development of businesses and industries utilizing immersive technologies.

C. The Louisiana Immersive Technologies Enterprise Commission, hereinafter referred to as the "commission," is hereby created as a political subdivision of the state to develop, operate, and maintain the Louisiana Immersive Technologies Enterprise.

D. The commission shall be governed by a board of commissioners composed of seven persons appointed as follows:

(1) One member shall be appointed by the secretary of the Louisiana Department of Economic Development.

(2) Three members shall be appointed by the chairman of the board of the Lafayette Economic Development Authority.

(3) Three members shall be appointed by the president of the University of Louisiana at Lafayette, or his designee.

E. The commission shall be domiciled in the parish of Lafayette.

F. The board of commissioners shall elect, from its membership, a chairman, a vice chairman, and a secretary-treasurer. Commissioners shall serve without compensation.

G. A majority of the total membership of the board of commissioners shall constitute a quorum in order to transact business of the commission. No contract shall be approved or any financial obligation incurred by or on behalf of the commission unless approved by a majority vote of the members of the board of commissioners.

H.(1) Except as provided in Paragraph (2) of this Subsection, each member of the commission shall be appointed for a term of three years and shall serve until their successors have been appointed.

(2) The initial members of the commission shall serve the following staggered terms:

(a) The initial member appointed by the secretary of the Louisiana Department of Economic Development shall serve an initial term of one year and thereafter his successor shall serve a term of three years.

(b) One of the initial members appointed by the chairman of the board of the Lafayette Economic Development Authority shall be designated by the chairman to serve an initial term of two years and thereafter his successor shall serve a term of three years.

(c) One of the initial members appointed by the chairman of the board of the Lafayette Economic Development Authority shall be designated by the chairman to serve an initial term of three years and thereafter his successor shall serve a term of three years.

(d) One of the initial members appointed by the president of the University of Louisiana at Lafayette, or his designee, shall be designated by the president or his designee to serve an initial term of two years and thereafter his successor shall serve a term of three years.

(e) One of the initial members appointed by the president of the University of Louisiana at Lafayette, or his designee, shall be designated by the president or his designee to serve an initial term of three years and thereafter his successor shall serve a term of three years.

(3) Any member may be removed by his or her respective appointing authority, with or without cause, solely at the discretion of the appointing authority.

(4) Any vacancy occurring in the membership of the commission shall be filled by the appointing authority and any person appointed to fill a vacancy shall serve for the remainder of the unexpired term.
