§940. Louisiana Historic Cemetery Trust Fund; creation

A. There is hereby created a special fund in the state treasury to be known as the Louisiana Historic Cemetery Trust Fund. The source of the monies to be deposited into the fund shall be grants, gifts, and donations received by the state for the purposes of this Chapter, any other revenues, whether local, state, or federal, as may be provided by law, and other monies which may be appropriated by the legislature to the fund.

B. After compliance with the requirements of Article VII, Section 9(B) of the Constitution of Louisiana, relative to the Bond Security and Redemption Fund, an amount equal to that deposited into the state treasury from the sources provided in Subsection A of this Section shall be deposited in and credited to the fund. The advisory board shall administer the fund and all allocations made therefrom. The monies in the fund shall be invested by the treasurer in the same manner as the state general fund, and all unexpended and unencumbered monies remaining in the fund at the end of each fiscal year shall remain in the fund.

C. The monies in the fund shall be allocated and disbursed by the advisory board solely as provided for and in accordance with the provisions of this Chapter.
