PART III.  GENERAL POWERS, DUTIES AND FUNCTIONS

§21.  Functions

A.  The functions of the department shall be to study, administer, construct, improve, maintain, repair, and regulate the use of public transportation systems and to perform such other functions with regard to public highways, roads, and other transportation related facilities as may be conferred on the department by applicable law.

B.  The department may construct and maintain within the right of way of any state highway or section thereof bicycle paths.  Before the construction of any such facilities the department must find and declare that the construction thereof is necessary in the public interest and will contribute to the safety of bicyclists and the motoring public.

C.  Repealed by Acts 1999, No. 362, §1, eff. June 16, 1999.
