§2116.5.  Rules; program retroactive

A.(1)  The secretary of the department or his designee shall develop and maintain a state personal assistance policy plan which shall include but not be limited to the following:

(a)  Criteria for eligibility of a person with significant disabilities for the services.

(b)  Criteria for determining the number of hours per week of services to be provided to a person with significant disabilities.

(c)  Determination of how program funds will be disbursed.

(d)  Criteria for determining prioritization of the State Personal Assistance Program waiting list.

(2)  In developing and maintaining a state personal assistance policy, the secretary shall solicit consultation from an advisory panel, that shall include representatives from the fiscal agents, and consumers.

B.  The secretary shall promulgate rules to implement this Chapter.

C.  The department shall implement this Chapter to the extent funds are appropriated by the legislature.

D.  The department is authorized to implement and operate the State Personal Assistance Program, in accordance with the provisions of this Chapter, retroactive to December, 1989.
