§160.10.  Employer assumption and prohibition

A.  An employer who hires a participant or other eligible individual who is currently insured through the project may assume or buy into the remaining term of the participant's or individual's certified health plan based on a monthly pro rata cost of the coverage year.  Such an assumption or buy-in payment shall be paid to the department and used for the purposes of this Subpart.  After expiration of the current coverage year or benefit period, full-time employment of a participant shall disqualify his participation in the project, unless he qualifies for the low-income program.

B.  An employer who is currently providing health insurance coverage to an employee or an employee's dependent, or both, shall not discontinue, restrict, or otherwise fail to increase or extend health insurance coverage to the employee or the employee's dependent solely with the intent to render that employee eligible to receive benefits through the demonstration project.  Such action by an employer shall be reported to the department, the commissioner of insurance, and the Louisiana Workforce Commission.
