§1458.  Refusal or revocation of license; appeal procedure

Upon the refusal of the department to grant or renew a license, or upon the revocation of a license, the applicant or licensee shall have the right to appeal such action by submitting a written request to the secretary of the department within ten days after the receipt of the notification of the refusal or revocation.  Receipt of notice is presumed seven days after mailing to the address given by the facility on its most recent application.  The appeal hearing shall be held no later than thirty days after the request therefor, except as provided in the Administrative Procedure Act, and shall be conducted in accordance with applicable regulations of the department and provisions of the Administrative Procedure Act.
