§1454.  Requirement of licensure; standards; annual fee

A.  All transitional youth residences shall be licensed before beginning operation.

B.  The department shall develop and publish minimum standards for licensing transitional youth residences to accomplish the purposes of this Chapter.  It shall review such standards and, if necessary, revise and amend them at least once every six years.  The secretary of the department may waive compliance with any standard if the intent of the standard is being met and if the health, safety, and well-being of the persons in care are not affected.

C.  Application for a transitional youth residence license shall be made by the facility to the department on forms furnished by the department.  Upon receipt of the application for licensure and the appropriate fee, the department shall inspect the facility to determine if it meets the minimum standards, and if so shall issue a license.  The department may, in appropriate cases, issue a provisional license if a facility meets most, but not all, of the requirements; but in no case shall a provisional license extend beyond six months.

D.  There shall be an annual licensing fee of two hundred dollars for each transitional youth residence caring for six or fewer transitional youths; four hundred dollars for each transitional youth residence caring for at least seven but fewer than eleven transitional youths; and six hundred dollars for each transitional youth residence caring for twelve or more transitional youths.
