§1496.14.  Rapides Parish Tri Fire Protection District

A.  Notwithstanding the provisions of R.S. 40:1495 and 1496, the board of commissioners of the Rapides Parish Tri Fire Protection District is hereby created.  The board of commissioners shall perform all duties, functions, and powers provided in this Part, including setting the limits of the district by resolution, and shall be responsible for the operation and maintenance of the district.  

B.  The board shall consist of five members, three of whom shall be appointed one each by the governing authority of the municipalities of Lecompte, Forest Hill, and Woodworth; one of whom shall be appointed by the governing authority of Rapides Parish; and one of whom shall be appointed by the Central Louisiana Association of Nurserymen in Forest Hill.  All members shall be bona fide residents and qualified voters within the limits of the district during their terms of office.  Members shall serve without compensation, however such members shall be entitled to reimbursement of actual expenses incurred in connection with official business of the district.  

C.  Each member shall serve a ten-year term.  However, the members initially appointed shall serve terms as follows: the three members appointed by the governing authorities of Lecompte, Forest Hill, and Woodworth shall serve for initial terms of ten, eight, and six years to be determined by said governing authorities; the member appointed by the governing authority of Rapides Parish shall serve an initial term of four years; and the member appointed by the Central Louisiana Association of Nurserymen shall serve for an initial term of two years.  If a vacancy occurs, it shall be filled for the unexpired term by the body originally making the appointment so vacated.  

D.  The district shall enter into such contracts with the governing authorities of municipalities within the district as the board considers necessary or desirable to acquire, maintain, and operate buildings, vehicles, machinery, and equipment for effective fire prevention and control.  Such contracts shall stipulate that each municipality shall retain the ownership of any movable or immovable property utilized by the district.  

E.  The board is hereby authorized to levy and collect an additional sales and use tax not in excess of one-half of one percent within the district, which tax shall be in addition to all other taxes and shall be collected at the same time and in the same manner as set forth in R.S. 47:301 through 317.  In accordance with the provisions of Section 29(B) of Article VI of the Constitution of Louisiana, the additional sales and use tax is authorized to exceed the limitation in Section 29(A) of said Article.  The sales and use tax so levied shall be imposed by resolution of the board and shall be levied upon the sale at retail, the use, lease, or rental, the consumption and the storage for consumption of tangible personal property, and on sales of services in the district, all as defined in R.S. 47:301 through 317; provided, however, that the resolution imposing said tax shall be adopted by the board only after the question of the imposition of the tax shall have been submitted to the qualified electors of the district at an election to be conducted in accordance with the general election laws of the state of Louisiana, and the majority of those voting in said election shall have voted in favor of the adoption of the resolution.  

F.  The boundaries of the district shall be composed of the following described area to wit:

Begin at the intersection of the Ward 2-Ward 4 Boundary line with the southern tip of the Claiborne Range Military Reservation and follow a hypothetical line to the point where the Range 1-2 line intersects with the Ward 1-2 boundary line.  From this point, follow the Ward 1-2 boundary line easterly to Bayou Clear.  Thence, southerly down Bayou Clear until its intersection with the Alexander State Forest.  Thence northwardly up Bayou Clear to LA 470, thence eastwardly and northwardly on LA 470 to its intersection with U.S. 71-167, thence northwardly on U.S. 71-167 to its intersection with LA 3170, thence eastwardly to its intersection with LA 457, thence northwardly on LA 457 to its intersection with LA 1, thence southeastardly along LA 1 to its intersection with Tiger Lake Road, thence along a hypothetical line to a point where U.S. Highway 71 and LA 457 intersect, thence southeastardly on U.S. Highway 71 to its intersection with Bayou Boeuf at Lloyd Bridge, thence southwestardly on a hypothetical line to the intersection where Highway 167 intersects the Evangeline/Rapides Parish Boundary line, thence follow the Evangeline/Rapides Parish Boundary line southwesterly to its intersection with Spring Creek, thence follow the meanders of Spring Creek to its intersection with LA 497, thence westward to U.S. Highway 165 to its intersection with Boy Scout Road, thence northward and westward on Boy Scout Road to its intersection with Otis Melder Road, thence westward on the Otis Melder Road to its intersection with Tatoo Road, thence westward on Tatoo Road to its intersection with North River Road, thence westward on North River Road to its intersection with the Ward 5 boundary line, thence northward and eastward along the Ward 5 boundary line until it intersects the Claiborne Range Military Reservation Boundary, thence southeasterly along Claiborne Range Military Reservation boundary to the Point of Beginning.  

G.  Notwithstanding any provision of this Part or other law to the contrary and particularly the other portions of this Section, Fire Protection District Number Nine and Fire Protection District Number Eleven of Rapides Parish are specifically excluded from the provisions of this Section.
