§1407.  Transfer of functions from Capital Construction and Improvement Commission

A.  The powers, duties and functions of the Capital Construction and Improvement Commission are hereby curtailed, limited and restricted to the retirement of the principal of and interest on all bonds issued by the said commission under the provisions of Act 731 of the 1965 Regular Session of the Legislature, Act 842 of the 1966 Regular Session and Act 1193 of the 1967 Regular Session and for the sole purpose of the retirement of the principal of and interest on such bonds, the Capital Construction and Improvement Commission, as presently constituted, shall continue to function as an agency of the state until the principal of and interest on all bonds issued under the provisions of the above named acts have been paid and retired.

B.  All other powers, duties and functions heretofore vested in and exercised by the Capital Construction and Improvement Commission under the provisions of the acts enumerated in subsection (A) and under the provisions of Acts 684 and 2815 of the 1970 Regular Session of the Legislature are hereby transferred to and vested in the State Bond Commission, specifically including, by way of extension and not of limitation, such functions as the supervision of construction, approval of estimates, the selection and employment of engineers, architects and other personnel necessary in connection with the administration of contracts for projects to be administered by the Capital Construction and Improvement Commission under the provisions of the acts named in subsection (A) and in this subsection, all of which functions are transferred to and vested in the State Bond Commission.  The State Bond Commission is authorized and directed to administer all contracts and agreements previously executed by the Capital Construction and Improvement Commission and to enter into and execute any contracts heretofore authorized.

C.  The obligations heretofore incurred by the Capital Construction and Improvement Commission in connection with any construction contract or agreement shall be preserved and discharged by the State Bond Commission, all books, papers, records, money and other property heretofore possessed, controlled or used by the Capital Construction and Improvement Commission in the exercise of the functions hereby transferred and to the extent practicable and necessary all employees heretofore engaged in the performance of such functions are hereby transferred to the State Bond Commission.

D.  The transfer provided for in this section shall take effect and be operative on January 1, 1973, and on said date all money remaining from any funds made available to or for the benefit and use of the Capital Construction and Improvement Commission shall be transferred to and used by the State Bond Commission in carrying out the functions herein transferred to it.

2Acts 1966, No. 84 created the Special State Schools Capital Construction and Improvement Commission, that was retitled Capital Construction, Schools, R.S. 39:466.1-R.S. 39:466.7, to provide for the construction of buildings, structures and School facilities comprising the capital outlay program of the Belle Chasse State School in Plaquemines Parish and the Southwest Louisiana State School in Acadia Parish and authorized the issuance and sale of bonds or obligations not to exceed two million dollars.

4Acts 1970, No. 68, enacting R.S. 39:466.11 through 39:466.13, authorized the Capital Construction and Improvement Commission to construct buildings, structures and other facilities comprising the capital outlay program of the Louisiana School for the Deaf in East Baton Rouge Parish and the furnishings and equipment therefor.

5Acts 1970, No. 281 provided for the issuance of not more than $3,000,000 of general obligation bonds by the State Bond Commission for a school of veterinary medicine at Louisiana State University at Baton Rouge, to be in lieu of bonds authorized by Acts 1968, No. 196; the act also provides for use of revenues from the dedications of Acts 1968, No. 196 and R.S. 4:163(A).
