§2047.  Vacancies

A.  When a vacancy on the commission occurs among the appointed members, the commission shall notify by certified mail the nominating entity within ten days and the vacancy shall be filled by gubernatorial appointment in the same manner as the original appointment.  The member appointed to fill a vacancy shall serve the remainder of the unexpired term.  If the vacancy occurs with three or more years remaining in the term, such service shall be considered as one term for purposes of the limit on the duration of service.

B.  Should a nominating entity fail to submit the required number of nominations within thirty days after notification, the governor shall make the appointment consistent with R.S. 23:2043, but without regard to nominations by such entity.
