§51.1.  Contribution to cost of foster care by natural or adoptive parent or tutor

A.  When the department, under the authority of R.S. 46:51(8), contracts with foster parents for the board and care of children entrusted to its custody, the natural or adoptive parent or tutor will be required to contribute to the cost of care of the child in such manner as is commensurate with the ability to do so and in accordance with a sliding scale which shall be established by the department.  The scale shall have as its primary base the total taxable income reported for federal income tax purposes for the preceding year and any additional benefits he or she is presently receiving.  

B.  Assistance from the natural or adoptive parent or tutor will only be made to aid in defraying the cost of such contracts, plus amounts and benefits available to the foster child or through his natural or adoptive parent or tutor from other sources, including such sources as social security, veterans administration, private insurance, Department of Health and Human Resources, Department of Education, including special education and vocational rehabilitation.
