§2391.  Definitions

As used in this Chapter:

(1)  "Community Residential Program" means a residential program for not more than six physically disabled or mentally disabled, or both, persons at one site and may include such programs as:

(a)  Community (group) homes.  

(b)  Supervised apartment living.  

(c)  Out-of-home respite care.  

(2)  "Department" means the Department of Health and Human Resources.  

(3)  "Eligible private, nonprofit organizations" means organizations who provide or will provide services to clients of the Department of Health and Human Resources and who meet the requirements of Section 501(c)(3) of the Internal Revenue Code of 1954, 26 U.S.C. §501(c)(3).  

(4)  "Equipment and furniture" means any equipment, furniture, or furnishings necessary to the operation of the program including vehicles; office equipment; fire and safety devices; furniture; household supplies such as linens, rugs, kitchen appliances, dishes, and eating and cooking utensils; and equipment for maintenance.  

(5)  "Mentally or physically disabled, or both," means any person who has a mental or physical impairment, or both, which limits one or more major life activities such as caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, or walking and is attributable to any physiological disorder or condition, cosmetic disfigurement, or loss of limbs affecting one or more of the body's systems: neurological; musculoskeletal; special sense organs; respiratory, including speech organs; cardiovascular; or any mental or psychological disorder such as mental retardation, organic brain syndrome, and emotional or mental illness.  

(6)  "Modifications/renovations" means any structural modifications or renovations, or both, which are required for safety, licensing, or certification reasons or to accommodate the needs of the program.
