§231.3.  FITAP; school attendance; limitation on benefits

A.  Each Family Success Agreement shall incorporate a plan to ensure appropriate child development, educational attainment, and school attendance for each minor child within this agreement.  Such a plan shall include the obligation of the participant to actively participate in their child's education through parent-teacher conferences, homework assistance, or other activities, to ensure that the participant is aware of their child's educational progress, existing attendance or academic problems.

B.(1)  The Family Success Agreement shall indicate necessary actions and responsibilities the parent should take in order to address issues of truancy, academic failure, behavior, or other issues that could jeopardize the child's success in school.  The participant shall provide documentation, such as report cards, to the department that they are ensuring school attendance and are engaged with their child's learning.  Failure of the participant to provide this information, or failure to comply with the activities set forth in the Family Success Agreement, shall result in a sanction as specified in R.S. 46:231.7.

(2)  Work-eligible, minor parents with children who have not yet received a high school diploma or equivalency shall attend school or related education classes designed to obtain a high school diploma or its equivalent.  School attendance shall be the primary work activity for those minor parents who do not have a high school diploma or equivalency.  These expectations shall become part of the recipient's Family Success Agreement.  Minor parents who fail to participate in these activities are subject to sanction for non-participation and are considered to be out of compliance with a Family Success Agreement.

C.  Any child attending a private or parochial school in this state shall be subject to the provisions of this Section.

D.  If the amount payable to a family is reduced by reason of this Section, each member of the family shall be considered to be receiving such aid for purposes of eligibility for medical assistance under Title XIX of the Social Security Act (Medicaid) for as long as such aid would otherwise not be so reduced.
