§1192.  Insurance Education Advisory Council

A.  The Insurance Education Advisory Council is hereby created within the Department of Insurance.  The council shall be comprised of the commissioner of insurance and eleven other members with experience or training in the field of insurance appointed by the commissioner, subject to confirmation by the Senate, as follows:

(1)  Five insurance agents licensed in Louisiana, at least one of whom is appointed from a list of three nominees submitted by each of the following insurance trade associations:

(a)  Louisiana Association of Life Underwriters.

(b)  Independent Insurance Agents of Louisiana.

(c)  Professional Insurance Agents of Louisiana.

(d)  Louisiana Surplus Lines Association.

(e)  Louisiana Association of Health Underwriters.

(2)  Five representatives of insurance companies admitted to do business in Louisiana, at least one of whom is appointed from a list of three nominees submitted by each of the following insurance trade associations:

(a)  Louisiana Fire and Casualty Association; and

(b)  Louisiana Insurers Conference.

(3)  One bail agent from the Association of Louisiana Bail Underwriters.

B.  In making the initial appointments, four members shall be appointed for a term of one year, three members shall be appointed for a term of two years, and four members shall be appointed for a term of three years.  Thereafter, members shall serve three-year terms.  Vacancies shall be filled in the same manner as the original appointment.  No member shall serve more than two consecutive three-year terms.  Members shall serve without compensation.

C.  The council shall review and evaluate each educational program which applies for certification as a registered insurance agent or bail agent prelicensing program.  The council shall review and evaluate the course materials, curriculum, and the credentials and qualifications of the instructors.  No information or materials reviewed and evaluated by the council may be used for any personal reasons or gain by any member of the council.  The council shall make recommendations to the commissioner of insurance with respect to applicants for certification and generally with respect to educational requirements for insurance agents.  The council shall perform such other duties related to educational requirements for insurance agents and bail agents as the commissioner may require.  The council shall meet at least two times each year and more often as deemed appropriate and necessary.
