§2155.  Rules, regulations, and standards for licenses

A.  The department shall promulgate rules and regulations to carry out the provisions of this Part in accordance with the provisions of the Administrative Procedure Act.

B.  The department shall promulgate minimum standards for adult residential care homes as defined in this Part which, at a minimum, shall:

(1)  Promote the health, safety, and welfare of persons residing in such facilities.

(2)  Promote safe, comfortable, and proper physical facilities which, at a minimum, comply with applicable provisions of the Life Safety Code and the Louisiana Sanitary Code.

(3)  Insure adequate supervision of those attending or residing in such facilities by capable, qualified, and healthy personnel.

(4)  Insure adequate and healthy food service.

(5)  Prohibit discrimination by adult residential care homes on the basis of race, color, creed, sex, disability, as defined in R.S. 51:2232(11), national origin, or ancestry.

(6)  Include procedures by which next of kin or legal representatives of residents are given an opportunity for consultation and to receive information about residents of such facilities.

(7)  Include procedures for the receipt, recording of, and disposition of complaints.

(8)  Require the facility to make adequate provision for residents in the event of an emergency, or natural disaster as provided in the facility's approved emergency and evacuation plan.

(9)  Repealed by Acts 2006, No. 660, §2, eff. June 29, 2006.

C.  The department shall promulgate standard forms for applications and for inspection reports.

D.  The secretary of the department, in specific instances, may waive compliance with a minimum standard upon determination that the economic impact is sufficiently great to make compliance impractical, as long as the health and well-being of the staff and/or residents is not imperiled.

E.  The department shall not regulate or attempt to regulate or control the content of the religious curriculum of a facility sponsored by a church or religious organization so long as the civil or human rights of the clients or residents are not violated.
