§1236.17.  Louisiana Bio-Recovery Technician Certification Commission; creation; domicile; membership; terms of office; vacancies

A.  The Louisiana Bio-Recovery Technician Certification Commission is hereby created within the Department of Health and Hospitals.

B.  Its domicile shall be in the city of Baton Rouge, Louisiana.

C.  The commission shall consist of five members, three of whom shall be respectively, the assistant secretary of the office of public health, Department of Health and Hospitals or his designee; a representative from the Department of Environmental Quality, appointed by the governor; a current coroner in the state of Louisiana, appointed by the governor; and two persons, who shall be duly recognized practicing bio-recovery technicians, appointed by the governor.

D.  The two bio-recovery technicians initially appointed shall serve terms, beginning with the effective date of this Subpart as follows: one member for three years and one member for four years.  Thereafter, each bio-recovery technician appointed to the commission shall be appointed and serve for a term of four years.  The representatives from the Department of Environmental Quality and the Department of Health and Hospitals and the coroner shall serve terms concurrent with the appointing governor.

E.  Any vacancy occurring prior to the expiration of a member's term shall be filled in the same manner as the original appointment.  A member appointed to fill a vacancy shall hold office for the remainder of the unexpired term of the predecessor member of the commission.
