§5.12.  Standard school health form; School Health Advisory Board

A.  The secretary of the Department of Health and Hospitals shall establish in the office of public health an advisory board to develop a standard health form for use in all city, parish, and other public school systems.  The purpose of the standardized health form shall be to eliminate the duplication of information submitted to schools and school nurses relative to immunizations, illnesses, allergies, and sports physicals.

B.  There is hereby created within the Department of Health and Hospitals, office of public health, the School Health Advisory Board, which shall consist of the following members recommended by the state Department of Education and the Department of Health and Hospitals:

(1)  Two representatives from the School Nurse Association.

(2)  Two representatives from the Assembly on School Based Health Care.

(3)  One representative from the Head Start Association.

(4)  Two representatives from the Louisiana High School Athletic Association.

(5)  Two pediatricians from the Louisiana Chapter of the American Academy of Pediatrics.

(6)  One physician from the Louisiana Academy of Family Practice.

(7)  One representative from Medicaid/KidMed.

(8)  One member from the Women and Infant Children (WIC) program.

(9)  One representative from the office of public health, Early Steps Program.

(10)  Two school principals from elementary and secondary schools.

(11)  Two school superintendents.

(12)  One member from the Catholic Schools Association.

(13)  One staff member from the office of public health shall be appointed chair of the advisory board.

C.  Members of the advisory board shall not receive compensation for their services to the board.

D.  The Department of Health and Hospitals, office of public health shall be responsible for providing administrative and technical assistance to the advisory board.  The implementation of the use of the standard health form shall be no later than August, 2005 and such form shall be used exclusively in schools by August, 2007.

E.  The office of public health, through the Department of Health and Hospitals and the Department of Education shall jointly promulgate rules and regulations in accordance with the Administrative Procedure Act relating to the use and distribution of the standardized school health form.
