§3356.  Advisory Committee on Respiratory Care; creation

A.(1)  The Advisory Committee on Respiratory Care is hereby created and shall be composed of ten members appointed by the governor to assist the Louisiana State Board of Medical Examiners in the administration of the provisions of this Chapter.  

(2)(a)  Two members of the committee shall be licensed respiratory therapists registered by the National Board for Respiratory Care or its successor organization and shall be selected from a list of ten names submitted by the Louisiana Society of Respiratory Therapy.  

(b)  Two members of the committee shall be licensed respiratory therapy technicians certified by the National Board for Respiratory Care or its successor organization and shall be selected from a list of ten names submitted by the Louisiana Society of Respiratory Therapy.  

(c)  Four members of the committee shall be physicians duly licensed to practice medicine in Louisiana and shall be selected from a list of eight names submitted by the Louisiana State Medical Society.  

(d)  One member of the committee shall be a hospital administrator and shall be selected from a list of three names submitted by the Louisiana Hospital Association.  

(e)  One member of the committee shall be a citizen of Louisiana who is not employed in the delivery of health care.  

B.(1)  The nominating organizations shall submit their lists of nominees to the governor by November 1, 1985.  

(2)  Members shall serve at the pleasure of the appointing governor.  Each appointment by the governor shall be submitted for Senate confirmation.  

C.  A vacancy in an unexpired term shall be filled in the manner of original appointment.  

D.  A majority of the members of the committee shall elect a chairman.  

E.  The committee shall meet no less than quarterly at a time and place to be determined by the chairman of the committee.  A majority of the members of the committee shall constitute a quorum for the transaction of all business.  

F.  Each member shall serve without compensation but shall be reimbursed for travel expenses incurred in attendance at meetings of the committee and other expenses incurred on business of the committee at its direction.  Such compensation shall be paid from funds derived from fees as provided in R.S. 37:3359.  

G.  The Advisory Committee on Respiratory Care shall serve as a clearinghouse for tutorial programs established for the purpose of sponsoring students accepted in American Medical Association approved nontraditional programs.  The committee may visit the programs annually and shall provide a report to the board of the following conditions:

(a)  Compliance with this Chapter.  

(b)  Students listed in the program.  

(c)  Ratio of graduates passing the National Board of Respiratory Care entry-level examination.  

(d)  Recommendations to approve continuance of the program.
