§2313.  Revocation, refusal, suspension, probation, restrictions, reprimand, and censure

A.  The board may reprimand or censure a registrant or certified holder or may suspend, revoke, or refuse to renew any license or permit issued under this Chapter upon proof that:

(1)  The certificate was obtained through error of the board or fraud, misrepresentation, or concealment of material facts by the applicant.

(2)  The holder is grossly incompetent, grossly negligent, or is guilty of unethical conduct.  Unethical conduct means:

(a)  Any conduct likely to mislead, deceive, or defraud the public;

(b)  Advertising of any character in which untruthful or misleading statements are made;

(c)  The performance of any service in pursuance of any such advertising;

(d)  The representation that certain services or parts are necessary, or have been or will be used in the repairing of a radio, television, playback or recording device, video cassette recorder, or satellite signal receiving equipment, although such services or parts are not necessary or have not been used in such repairs;

(e)  Employing a person to repair and/or service radios, televisions, playback or recording devices, video cassette recorders, or satellite signal receiving equipment who does not have a current and proper license from the board; or

(f)  Willfully aiding or abetting another to evade or violate the provisions of this Chapter or knowingly combining or conspiring with an unlicensed person or acting as an agent, partner, associate, or otherwise of an unlicensed person with intent to evade provisions of this Chapter.

(3)  Conviction of a felony by the holder in any court if the acts for which the conviction was obtained are found by the board to have a direct bearing on whether the holder shall be entrusted to serve the public in the capacity as a radio and television technician or apprentice.

B.  If the board determines that unethical conduct, as defined by Subsection A hereof, has taken place, the board may impose a fine of not less than fifty dollars nor more than three hundred dollars, which shall be paid to the board.

C.  In addition to a fine, the board, as a probationary condition or as condition of the reinstatement of any license or permit suspended or revoked for causes hereunder, may require the holder thereof to pay costs of the board proceedings, including attorney and investigative fees, not to exceed seven hundred dollars, to the board.

D.  A suspended license or permit shall be subject to expiration during suspension.
