§3474.  Board of commissioners; qualifications; selection; term; vacancies; compensation

A.  The authority shall be governed by a board of twelve commissioners, consisting of two ex officio members and ten commissioners appointed by the governor and chosen as provided in this Section on the basis of their demonstrated experience in maritime or business leadership, or both, and their stature and ability to act effectively for the best interests of Louisiana. Such commissioners shall not be appointed or elected commissioners or board members of the ports of Louisiana.

B.(1)  The two ex officio commissioners shall be:

(a)  The secretary of the Department of Transportation and Development or his designee.

(b)  The secretary of the Department of Economic Development or his designee.

(2)  The appointed voting commissioners shall be chosen as follows:

(a)  One shall be selected from a list of three nominees submitted by the Port of New Orleans, who shall serve an initial term of six years.

(b)  Two shall be selected from a list of seven nominees submitted by Louisiana's six remaining deepwater ports and Port Fourchon, with each deepwater port and Port Fourchon recommending one nominee, who shall serve initial terms of five years.

(c)  One shall be selected from a list of three nominees submitted by the Ports Association of Louisiana, who shall serve an initial term of five years.

(d)  Two members shall be selected from the state at large, who shall serve initial terms of four years.

(e)(i)  One member shall be selected from the local governmental subdivision in which the main site of any offshore or onshore terminal facility is to be located, or offshore from which the main site of such terminal will be located, selected from a list of three nominees submitted by the port authority located in such parish, who shall serve an initial term of four years.  Such appointment shall be made within three months of the time that the board finally approves the proposed main site of such facility.

(ii)  The appointment shall be from a list of three names to be submitted by the port authority of the local governmental subdivision in which such main site is to be located, or the port authority from which the offshore main site will be located.

(f)  One member shall be selected from the state at large who shall be a person with at least ten years of transportation experience in Louisiana, who shall serve an initial term of four years.

(g)  One member shall be selected from a list of three names to be submitted by the Red River Waterway Parishes, who shall serve an initial term of four years.

(h)  One member shall be selected from a list of three names to be submitted by the Louisiana Landowners Association, who shall serve an initial term of four years.

(3)  The successors to the voting commissioners appointed as provided for in Paragraph (B)(2) shall be appointed for terms of six years.  However, a member shall serve until his successor is appointed unless removed as provided for in Paragraph C(1).  A commissioner may be reappointed.

(C)(1)  Each appointment by the governor shall be submitted to the Senate for confirmation. Each of the commissioners shall serve at the pleasure of the governor and may be removed by the governor with cause at his discretion.

(2)  All vacancies shall be filled in the same manner and the appointee shall have the proper qualifications.

D.  The members of the board of commissioners shall serve without compensation but shall be reimbursed for travel expenses incurred in attending meetings at rates and standards as promulgated by the division of administration.
