§1942.  Purpose

The purpose of this Part is to assure and require that the state shall fund special education and related services for children with exceptionalities in this state, and that this program shall be administered by the Department of Education in keeping with the laws of this Part and with policies, rules, and regulations developed pursuant to these laws by the Department of Education with the approval of its governing authority and in conjunction with other state and private agencies and nonpublic schools.  Nothing in this Chapter shall be construed to limit or expand specific requirements of state or federal laws that govern other state agencies providing noneducational services to children with exceptionalities.  For purposes of this Chapter, the governing authority of the Department of Education shall be defined as the State Board of Elementary and Secondary Education or its successor.
