§1316.  Penalty for violation of Part

A.  No person shall:

(1)  Interfere with the commissioner, the state chemist, or their representatives in the performance of their duties in carrying out the provisions of this Part.

(2)  Falsify a tonnage report or otherwise avoid payment of the inspection fee.

(3)  Make, on bags or packages or in any printed or advertising matter issued or circulated, any false or misleading statement concerning the value of a fertilizer.

(4)  Adulterate any lot or shipment of fertilizer sold in this state.

B.  Any guarantor, individual, company, partnership, or corporation found to be in violation of any of the provisions of this Part shall bear the costs of all inspections, investigations, laboratory analyses, and adjudicatory hearings associated with the violation.

C.  Whoever violates a provision of this Section or any other provision of this Part shall be fined not less than fifty dollars nor more than five hundred dollars.
