70.085 Summons, return of -- Amendment if erroneous -- Penalty. The return on a summons by an officer must state when and how the summons was served, and, if erroneous, may, with leave of the court, be amended according to the truth. An officer who makes an erroneous return may be fined by the court not exceeding ten dollars ($10), and is liable to the person aggrieved for any injury caused by the error. History: Amended 1966 Ky. Acts ch. 255, sec. 85. -- Transferred 1952 Ky. Acts ch. 84, sec. 1, effective July 1, 1953, from C.C. sec. 49.
