213.081 Permit to cremate or transport body -- Simultaneous cremation. (1) (2) (3) No person shall cremate or cause to be transported for the purpose of cremation the body of any person whose death occurs in the Commonwealth, without first obtaining from the coroner of the county in which the death occurred, a permit stating the cause of death and authorizing the cremation or transportation for cremation of the body. The permit shall be filed immediately following cremation with the local registrar of vital statistics. Fetal death remains shall require the same permit required by subsection (1) of this section. Notwithstanding KRS 367.97514, fetuses may be cremated by simultaneous cremation. Effective:April 14, 2022 History: Amended 2022 Ky. Acts ch. 210, sec. 20, effective April 14, 2022. -Created 1990 Ky. Acts ch. 369, sec. 15, effective July 13, 1990. Legislative Research Commission Note (4/14/2022). This statute was amended by 2022 Ky. Acts ch. 210, sec. 20. Section 38 of that Act states, "Sections 1 to 31 of this Act may be cited as the Humanity in Healthcare Act of 2022."
