63.160 Reinstatement by Governor.

63.160 Reinstatement by Governor. (1) (2) (3) Any peace officer removed from office pursuant to KRS 63.140 may, within ten (10) days thereafter, file with the Governor a petition for reinstatement. He shall give written notice of the filing of such petition to the county attorney of his county and the Commonwealth's attorney of the district of which his county is a part, and the Governor shall give notice to the Attorney General. The Governor shall hear the evidence, which may be oral or by deposition, and arguments presented. If the Governor is of the opinion that the peace officer did all in his power to protect the life and person of the prisoner, and did not neglect to perform his legal duty, the Governor shall order the immediate reinstatement of the removed peace officer. The order of the Governor shall be final, and should he fail to reinstate, his previous order removing shall also be final. When a peace officer is reinstated under this section, his original fidelity bond shall continue in full force and effect. Effective: October 1, 1942 History: Recodified 1942 Ky.
