38.235 Acceptance of workers' compensation law -- Direct payment of benefits. (1) (2) The Department of Military Affairs shall accept the provisions of KRS Chapter 342 for the benefit of members of the Kentucky National Guard while members are on state active duty. The department may, in lieu of procuring additional extended insurance coverage, elect to avail itself of the provisions of KRS 342.340, relating to the direct payment of benefits, for the purpose of paying the benefits provided under subsection (1) of this section.
