344.362 Exceptions to unlawful practice of discrimination because of sex. Nothing in KRS 344.360 shall apply to: (1) The YMCA, YWCA, and similar type single sex dormitory rental properties, including, but not limited to, those dormitories operated by institutions of higher education; (2) A landlord who refused to rent to an unmarried couple of opposite sex; (3) A landlord who chooses to rent only to men or only to women; provided that the landlord engages in the rental to no more than ten (10) persons or of no more than ten (10) self-contained units in an owner occupied housing accommodation; (4) Rooms or rental units where tenants would be required to share common bath or kitchen facilities; and (5) To any housing accommodation where it can be demonstrated that gender-based exclusions are necessary for reasons of personal modesty or privacy.
