224.40-605 Training and certification of persons operating waste site. (1) (2) The cabinet shall promulgate regulations which establish standards for the operator of any waste site or facility or portion thereof, whether publicly or privately owned, requiring such operators to do the following: (a) Attend a training session concerning the operation of the appropriate type of waste facility conducted by the Energy and Environment Cabinet; (b) Indicate sufficient skill and competency for proper operation of the waste site by adequate performance on an examination prescribed by the Energy and Environment Cabinet; (c) Pay a reasonable fee related to the cost of conducting training and certification sessions to be utilized to defray the cost of conducting the sessions; and (d) Renew the certificates of competence at reasonable intervals. No person shall authorize or allow any person who does not hold a certificate issued pursuant to subsection (1) of this section to have primary responsibility for the operation of any waste site or facility or portion thereof.
