304.15-090 Misstatement of age or sex.

304.15-090 Misstatement of age or sex. There shall be a provision that if the age or sex or both of the insured, or of any other person whose age or sex is considered in determining the premium or benefit, has been misstated, all amounts payable under this policy shall be such as the premium paid would have purchased at the correct age and sex. Such provision may provide that, in the event the age of the insured has been misstated, and if according to the correct age of the insured the coverage provided by the policy would not have become effective or would have ceased prior to acceptance of any premium for a period not covered by the policy, then the liability shall be limited to the refund, upon request, of all premiums paid for the period not covered by the policy.
