387.730 Testamentary nomination -- Succession of parent as guardian. (1) (2) A parent, spouse, or child of a partially disabled or disabled person who has been appointed as limited guardian, guardian, limited conservator, or conservator of that person may, by will, nominate an individual to succeed in that capacity upon the testator's death. Such nomination shall be reviewed by the court pursuant to KRS 387.620 upon admitting the will to probate if no other person is serving in that capacity at the time of the testator's death and no standby guardian or conservator has been appointed. When the biological or adoptive parents of a disabled person are appointed coguardians of that person and one (1) of the coguardians dies, the survivor shall become the successor guardian without any additional action by the court.
