149.060 Sale of timber from leased lands. If merchantable timber is taken from land leased to the Energy and Environment Cabinet, one-half (1/2) of the stumpage value of the timber shall be paid into the State Treasury and the other half (1/2) shall be paid to the lessor or his assigns. The sale of timber grown upon leased lands shall be made only by consent of all parties interested in the land or by court order. If all interested parties do not agree to sell the timber, the cabinet may, by a suit in equity, to which all persons interested shall be made parties, obtain an order directing the cabinet to sell merchantable timber on any leased lands.
