38.020 National Guard, how composed -- Acceptance or rejection of unit allotments by Department of Defense. (1) (2) The Kentucky National Guard shall consist of the officers, warrant officers, enlisted men and units as prescribed in tables of organization of the Department of the Army for the Army National Guard, and the officers, warrant officers, enlisted men and units as prescribed in the tables of organization of the Department of the Air Force, Air National Guard and the inactive Army and inactive Air National Guard. The Governor may accept or reject any or all organizations allotted to Kentucky by the United States Department of Defense. He may recommend to the United States Department of Defense the type of organizations both Army and Air Force, which he considers to be best suited to the performance of Kentucky's internal defense and security missions.
