281A.2102 Additional penalties for driving commercial motor vehicle under the influence of alcohol. In addition to the penalties established by this chapter for driving a commercial motor vehicle under the influence of alcohol: (1) Any person convicted of driving a commercial motor vehicle while the alcohol concentration of the person's blood or breath is four hundredths (0.04) to eight hundredths (0.08) shall be fined not less than twenty dollars ($20) and not more than fifty dollars ($50). (2) Any person convicted of driving a commercial motor vehicle while the alcohol concentration of the person's blood or breath is greater than eight hundredths (0.08) shall be fined under the provisions of KRS 189A.010(5)(a) to (d).
