Notwithstanding the provisions of this chapter, any application in which no protest is filed within the time prescribed by the department may be determined, under the provisions of KRS 281.640, on the basis of affidavits submitted by the applicant. Such affidavits, by order, will be required to be filed with the department within the time prescribed by the order, and in accordance with the rules and regulations of the department. If within any time period provided in the order a party fails to file affidavits, or otherwise fails to comply therewith, the party shall be deemed to be in default and the application may be summarily dismissed for lack of prosecution.
