(1) (2) Any motor carrier who is a nonresident of this state may, prior to operating any motor vehicle for hire in this state, appoint a person residing in this state as agent upon whom process may be served, and shall maintain such agent so long as the carrier operates a motor vehicle for hire in this state. The appointment shall be made by filing in the office of the department a statement giving the name and residence of the agent. If the motor carrier is an individual, the statement shall be subscribed by him; if the motor carrier is a partnership, corporation or an unincorporated association or company, the statement shall be subscribed by a partner or by an officer. When any change is made in the agent, the motor carrier shall immediately file with the department a statement of the change, and the former agent shall remain agent for the purpose of service until the statement of appointment of the new agent is filed. Any motor carrier who fails to appoint a resident of this state as agent upon whom process may be served or fails to maintain such agent after his original appointment shall thereupon become subject to the provisions of KRS Chapter 188, and the Secretary of State shall be his agent for the service of process.
