281.700 Abandonment or change of route, service or schedule.

No common carrier shall abandon or change any route or service, except upon
an application heretofore provided for; except, however, if it becomes
necessary, on account of the condition of the highways or other emergency, a
common carrier may make temporary changes in route, service or schedules
by notifying the department of such change. However, any carrier operating
under a suburban bus certificate may make such changes in routes and
schedules as may be necessary for the public convenience and shall not be
required to notify the department of such changes, unless such changed
condition is to continue for a period longer than ten (10) days, in which event
the carrier shall notify the department of the additional time that it desires such
change or changes to remain in effect, and the reason therefor, and the
department may grant such extension of time without a hearing.
If after the granting of a certificate of public convenience and necessity, a
nonprofit bus certificate or a permit, operation is not begun within sixty (60)
days thereof, said certificate or permit will become null and void, and cannot be
reinstated; provided, however, that the department may grant an additional
time to begin such operation, provided application therefor is made within the
sixty (60) day period.
If, after any motor carrier has operated in good faith, there is an abandonment
of the whole or any part of said operation, the department may notify said
motor carrier to immediately begin such operation, and if such motor carrier
fails to do so within thirty (30) days thereof, the department may enter an order
canceling said certificate or permit, with or without a hearing, or it may enter an
order requiring the motor carrier to operate such abandoned route.
