(1) (2) (3) (4) The department may order a motor carrier to appear at a fixed time and place for a hearing to be conducted in accordance with KRS Chapter 13B if the carrier, or the carrier's drivers or motor vehicles, violate: (a) The provisions of this chapter; (b) An order or administrative regulation promulgated by the department pursuant to this chapter; (c) The laws of this state; or (d) Is found to be unfit to carry out the duties, obligations, and responsibilities of a motor carrier. After a hearing pursuant to subsection (1) of this section, the department may suspend, revoke, alter, or amend any certificate or permit issued to a motor carrier, if the department is satisfied the carrier, or the carrier's drivers or motor vehicles, violated or refused to observe: (a) The provisions of this chapter; (b) An order or administrative regulation promulgated by the department; (c) The laws of this state; or (d) Has become unfit to carry out the duties, obligations, and responsibilities of a motor carrier. The renewal by the department of the certificate or permit of a motor carrier shall not be construed to be a waiver or condonement of any violation that occurred prior to the renewal and shall not prevent subsequent proceedings against the motor carrier. If a holder of a commercial driver's license issued from another jurisdiction fails to appear in answer to a citation or summons for an offense not covered by the nonresident violator compact authorized pursuant to KRS 186.860, the Division of Driver's Licensing shall notify the Division of Motor Carriers. Upon the determination that the failure to appear occurred from a violation committed in a commercial vehicle, the Division of Motor Carriers shall immediately notify the motor carrier. If the citation or summons is not satisfied within sixty (60) days of notification of the motor carrier, the Department of Vehicle Regulation shall suspend all licenses of the motor carrier issued pursuant to KRS 281.752.
