403.7539 Civil and criminal proceedings for violations of foreign protective orders.

Page 1 of 1 403.7539 Civil and criminal proceedings for violations of foreign protective orders. (1) Civil proceedings and criminal proceedings for violation of a foreign protective order for the same violation of the protective order shall be mutually exclusive. <br>Once either proceeding has been initiated, the other shall not be undertaken <br>regardless of the outcome of the original proceeding. (2) If criminal proceedings for violation of a foreign protective order are undertaken, the following shall apply: <br>(a) A person is guilty of violation of a foreign protective order when the person intentionally violates the provisions of a foreign protective order properly <br>authenticated, or filed and awaiting authentication, pursuant to KRS 403.7521 <br>and 403.7524. (b) Violation of a foreign protective order is a violation of KRS 403.763. (3) If civil proceedings for violation of a foreign protective order are undertaken, intentional violation of the foreign protective order by the person against whom it <br>was issued shall constitute contempt of court.
