66-1251. Same; contents of report to legislature; confidentiality; rules and regulations; failure to comply with reporting requirements. (a) On or before January 15, 2009, and annually thereafter, subject to the provisions of K.S.A. 2009 Supp. 66-1252, and amendments thereto, the commission shall report to the legislature on broadband service being provided in the state of Kansas. Such report shall include the following information:
(1) A report by census tract or other identifiable geographic unit indicating whether broadband service is available and the number of providers that offer service to customers in each census tract;
(2) beginning with the commission's report in 2010, a report by census tract of the change in: (A) The number of broadband providers; and (B) the geographic area or census tract where broadband service is available.
(b) The commission shall maintain the information provided by each provider pursuant to K.S.A. 2009 Supp. 66-1250, and amendments thereto, as confidential and shall report only the aggregated information by census tract to the legislature. In maintaining the information, the commission shall adhere to the confidentiality provisions in K.S.A. 66-1220a, and amendments thereto.
(c) The commission, after consulting with broadband providers, may adopt rules and regulations as necessary to establish the form and manner in which the provider information shall be submitted and to fulfill all other requirements of the commission under this act.
(d) The commission shall, in addition to those reports required by subsection (a), on or before January 15, 2008, and annually thereafter, report to the legislature the names of the broadband service providers that fail to comply with the reporting requirements of K.S.A. 2009 Supp. 66-1250, and amendments thereto.
