2006 Kansas Code - 75-7415

      75-7415.   Same; division successor to property and rights; conflict resolution. [See Revisor's Note] (a) The division of health policy and finance within the department of administration shall succeed to all property, property rights, and records that were used for or pertain to the performance of powers, duties and functions transferred to the division pursuant to K.S.A. 2005 Supp. 75-7413, and amendments thereto. Any conflict as to the proper disposition of property, personnel or records arising under this act shall be determined by the governor, whose decision shall be final.

      (b)   The provisions of this section shall not apply to the balances of any funds or accounts thereof appropriated or reappropriated for the department of social and rehabilitation services relating to the powers, duties and functions transferred by K.S.A. 2005 Supp. 75-7413, and amendments thereto. All such balances of any funds or accounts thereof shall be transferred by and be subject to the provisions of appropriation acts.
